This Privacy Policy forms part of the SilverChef Terms and Conditions (also found on SilverChef’s website (“Website”). It applies to Silver Chef Rentals Limited and each of its subsidiaries, and the expressions “SilverChef”, "we", "us" and "our" are a reference, collectively and individually, to Silver Chef Rentals Limited and each of its subsidiaries.

Information Privacy Principles

We are bound by the Information Privacy Principles ("IPPs") contained in the Privacy Act 2020 ("Privacy Act"). This Privacy Policy explains how we handle personal information in accordance with the IPPs (Further information in relation to the IPPs can be obtained from the Office of the Privacy Commissioner at: https://www.privacy.org.nz/.) The expression "personal information" is used in this statement to refer to information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether recorded in material form or not.

Collection of your personal information

We collect personal information so that we can conduct our business, market our services, comply with our legal obligations and for purposes as otherwise set out in this Privacy Policy. We collect a broad range of personal information about our customers, prospective customers, agents, dealers, contractors, suppliers service providers and employees.

The types of personal information that we collect from you will depend on how you interact with us. For example, your personal information will be collected when you purchase products, fill in an application form or send us a letter and it may be collected when you visit the Website.

This information may include, but is not limited to:

·         your identity and contact details (including your name, phone number, address, email address, date of birth, driver’s licence, passport and any other government issued identity document);

·         details of your business, or the business entity you represent;

·         your credit history, credit card or bank account numbers and other financial details;

·         your feedback, communications with our customer support and responses to surveys;

·         if you are a potential employee, contractor or other personnel, your employment history, intended role with us and other information provided as part of any application; and

·         other information that you provide to us in the course of our relationship with you, such as when you make an inquiry, request information, submit an order, provide feedback or correspond with us.

If you visit our website, we may collect anonymised information as set out in the section ‘Internet Privacy’ below.

We may also collect and hold sensitive information, which may include your biometric information (including photographs and voice or video recordings). If we do collect your sensitive information, we will only do so:

·         where it is reasonably necessary for our functions or activities, such as where we need it to help us to verify your identity; and

·         with your consent, or where we are otherwise required or authorised by or under law to do so. How we collect information We generally collect your personal information from you directly, including when you:

·         otherwise provide that personal information to us.

When we collect personal information directly from you, we will take reasonable steps at or before the time of collection to ensure that you are aware of certain key matters, such as the purposes for which we are collecting the information, the organisations (or types of organisations) to which we would normally disclose information of that kind, the fact that you are able to access the information and how to contact us (or example, where personal information is collected on a form, we will generally include a written privacy statement on the form which sets out these details).

We will collect your personal information directly from you where it is reasonable and practicable to do so. Where we collect information about you from a third party we will still take reasonable steps to ensure that you are made aware of the details set out above. For the purposes listed in the ‘How we use and disclose personal information’ section below, we may also collect personal information about you from third parties, including from:

Where you have had an interaction or business relationship with our related entities, we may collect details of that interaction or business relationship.

In order to manage our relationships with our customers, suppliers, employees and contractors.

 

We also disclose information to Equifax. This information may include your name, addresses, date of birth, gender, employer, occupation, drivers’ licence and the type of account you applied for. Details may also be provided relating to the conduct of your account, (for example, if we give you credit, you default on your payments, or you apply for financial assistance). This information is disclosed to Equifax for the purposes of Equifax carrying out its consumer credit reporting business. If you provide us with personal information about another individual, please provide that individual with a copy of this Privacy Policy so that they understand the way in which their personal information may be collected, used or shared. We receive that information on the basis they are aware of the provision of the information and have given you their authorisation for you to provide the information. This also applies if you direct an individual to give their personal information to us. If you do not provide the personal information we request, we may not be able to provide our services to you, or may not be able to provide the level of service we usually provide.

When you share your email address on the Website, this information is (or may be) stored by SilverChef using B2B marketing automation service provider, Pardot (Salesforce). By sharing your email address, you consent to this (as well as any other personal information) being stored by Pardot as well as on SilverChef’s New Zealand-based servers and cloud based storage. We will hold your personal information until such time it is no longer required by us in order to provide you with our services or we are no longer required by legislation to hold your personal information, whichever is longer.

How we use and disclose personal information

The personal information that you provide to us during interactions on the Website, and in other interactions between us, is used (among other things) to provide you with better service for the supply of our products and services to you. For example, the information we gather from your use of the Website enables us to provide more personalised products and services that are tailored to your needs.

Without limitation, we may use personal information that you have provided to us, or which we have obtained about you, for any of the following purposes:

·         to provide SilverChef’s products and services, including processing and communicating with you about your orders and applications;

·         to carry out transactions, such as customer billing and payments, employee transactions and customer transactions;

·         to undertake credit management activities;

·         for debt recovery purposes, which may also include disclosing information to debt collectors;

·         to provide promotional information, advertising, marketing and newsletters in hard copy or electronic form;

·         to communicate with customers, potential customers, suppliers, staff, contractors and others;

·         to protect and/or enforce our legal rights and interests, including defending any claim(s);

·         to comply with SilverChef’s legal obligations; to meet its reporting obligations as required by law; and carrying out any activity in connection with a legal, governmental or regulatory requirement on us or in connection with legal proceedings, crime or fraud prevention, detection or prosecution;

·         to contact you about our products and services and the products and services of carefully selected third parties which we think may be of interest to you (unless you ask us in writing not to);

·         to register your details and allocating or offering you rewards, discounts or other benefits and fulfilling any requests or requirements you may have in respect of our group companies’ loyalty or reward programmes and other similar schemes;

·         to carry out activities connected with the running of our business such as personnel training, quality control, network monitoring, testing and maintenance of computer and other systems and in connection with the transfer of any part of our business in respect of which you are a customer or a potential customer;

·         to generally customise your experience on the Website;

·         to facilitate a sale of our business (in whole or in part), or a change of control in our business or as part of a sale or transfer of our business assets; and

·         for general administrative and business purposes.

Disclosure of personal information

We will not sell, rent, lease or trade your personal information without your consent.

We will only use and disclose information about you for the purpose for which you gave us that information. We may disclose personal information about you to third party service providers who assist us in operating our business, our dealers and related bodies corporate, credit providers and credit reporting bodies, our professional advisors and government and regulatory agencies.

We may use, or allow our dealers to use, your personal information for the purposes of marketing or promoting our services. You may ask us not to use your information in this way.

We may also use and disclose personal information about you for a purpose (the "secondary purpose") other than the main purpose for which you gave us the information (the "primary purpose") where:

·         You would reasonably expect us to use or disclose the personal information for that secondary purpose and that secondary purpose is related to the primary purpose for which we collected the information (and directly related in the case of sensitive information);

·         You have given us your consent for the personal information to be used or disclosed for the secondary purpose.

·         Where there are reasonable grounds to believe that use or disclosure is necessary to prevent a threat to life or health;

Without limitation, we may disclose your personal information to:

·         our employees or contractors, for the purpose of them performing the work they do for us;

·         any business that supports our services, including any person that hosts or maintains any underlying IT system or data centre that we use to provide our services and products, including any legal support;

·         an agency for the purpose of conducting investigations on you (e.g. as required for antimoney laundering checks);

·         a person who can require us to supply your personal information (e.g. a regulatory authority);

·         any other person authorised by the Privacy Act or other legislation (e.g. a law enforcement agency); and

·         any other person authorised by you.

We may disclose your personal information to our related entities and third-party service providers who are based overseas, where this is necessary for the purposes set out above. This may mean your personal information is held and processed outside New Zealand. Presently, the recipients of such information may be in the United States of America, Australia or Canada. Where we disclose personal information overseas, we will take reasonable steps to ensure that the recipient is required to protect the information in a way that, overall, provides safeguards comparable to those in the New Zealand Privacy Act 2020, such as through appropriate contractual obligations.

Where we cannot ensure comparable safeguards, we will disclose your personal information overseas only where another exception under the Privacy Act applies, including where you have authorised the disclosure after being expressly informed that the overseas recipient may not be required to protect your information in a way that provides comparable safeguards to the Privacy Act.

In the event of any ‘notifiable privacy breach’ under Part 6 of the Privacy Act – that is, a privacy breach that it is reasonable to believe has caused (or is likely to cause) ‘serious harm’ to an individual – SilverChef has processes in place to ensure compliance with the Privacy Act.

Credit reporting

If you apply for credit facilities we may collect and hold various information related to your assets and financial position, including income details, expense details, asset values and taxation information. We may collect and give your credit information from and to a credit reporting body, such as Equifax New Zealand Information Services and Solutions Limited (formerly known as Veda).

We collect and use your credit-related information in order to assess your application for commercial credit (or assess your application to be a guarantor in relation to such credit), for securitisation-related purposes, for our internal management purposes that are directly related to the management of commercial credit including collecting overdue payments, where we reasonably believe that you have committed a serious credit infringement, and where otherwise required or permitted by law. Equally, we may share your credit information with Equifax if we give you credit, you default on your payments, or you apply for financial assistance.

Security of your personal information

We will take all reasonable steps to ensure that all personal information we collect, use or disclose is stored in a secure environment accessed only by authorised persons.

We will take reasonable steps to destroy or de-identify personal information when it is no longer required for the purposes for which we collected it or for legal requirements.

We will properly dispose of all paper files, letters and any other hard copy documents that contain personal information that is no longer required. All information stored in electronic form that is no longer needed will be deleted from our systems. While SilverChef employs advanced data encryption technology when interfacing with its customers, suppliers and other partners, users should be aware that there is a residual risk in transmitting any data electronically. This risk is inherent in all Internet dealings.

We utilise professional IT support services to assist us in securing your personal information.

How to access, correct or update your information

We will take all reasonable steps to ensure that all information we collect, use or disclose is accurate, complete and up-to-date. Please contact us if your details change or if you believe the information we have about you is not accurate or complete.

We will, on request, provide you with reasonable opportunity to access your personal information and to request that it be corrected or updated within a reasonable time of the request being made. A fee may apply to such access (but not to the making of the request). We will advise you of this before we proceed.

In some circumstances we are permitted to refuse to give access or to correct your personal information. If this occurs, we will provide you written reasons (unless it would be unreasonable to give reasons) and if required, advise you of your right to complain.

If you wish to make a complaint, we will acknowledge the complaint in writing within 7 days of you contacting the Privacy Officer. We may request the complaint be made in writing. We will then investigate the complaint and consult with third parties we consider it necessary to consult with. We will endeavour to fully investigate your complaint and provide you our decision within 30 days from the date of your complaint. Where we are unable to provide a decision regarding your compliant within 30 days we will communicate this to you along with the reason for the delay and the new timeframe for resolving the complaint.

If you are not satisfied with the outcome of any investigation you may request an independent review by an Executive of SilverChef.

Internet Privacy

In addition to the provisions of this Privacy Policy, this section further explains the management of personal information collected through your use of the Website.

When you use the Website our Internet Service Provider (“ISP”) may make a record of your visit and log your server address, your domain name, the date, time and duration of your visit, the pages and documents you accessed, the previous website you had accessed (i.e. the referring url) and the type of browser you are using. This information is collected for statistical purposes only, and SilverChef will not make any attempt to identify users according to their browsing activity.

In the unlikely event of an investigation, a law enforcement agency or other government agency may exercise its legal authority to inspect our ISP's logs.

While you are visiting our Website we may use automated technologies (including, but not limited to usage monitoring software, cookies, pixels, web beacons, sessions and other tracking technologies) to facilitate a more personalised web browsing experience and to collect and store certain information about your visit, including without limitation:

·         The IP address and domain name used by your device to connect to the Internet;

·         The operating system and the browser your device uses, and any search engine used to access the Website;

·         The date and time you are visiting and geographical area you a visiting from;

·         The pages you visit;

·         Your clicks and other activities on the Website;

·         The referring website or other platform (if any) through which entered the Website; and

·         Any other information you expressly provide (such as your name and areas of interest).

Except where you volunteer personal or business information we will not procure information about you via any alternative means while you visit our Website. SilverChef is not responsible for the content of any third party website or other related sites (including, but not limited to third party social media sites), or the way those sites collect, store, use, and distribute any personal information you provide. When visiting a third-party site from hyperlinks displayed on the Website, SilverChef encourages you to review the privacy policies and terms and conditions of the site/s in question, to ascertain how your personal information may be collected, stored, used and distributed. SilverChef accepts no liability for any engagement with or dealings between yourself and any third party or advertiser.

Unsolicited Electronic Messages – Approval

To the extent you provide SilverChef with an email address, you agree that SilverChef may send you commercial electronic messages. You can request to be removed from SilverChef’s mailing list at any time and SilverChef will comply with your request for removal. To request to be removed from a mailing list, click ‘Unsubscribe’ in the footer of an electronic message. If you do not see this, you can contact SilverChef’s Privacy Officer to action this via email, phone, or by physical mail.

SilverChef reserves the right, in its sole and absolute discretion, to update or revise this Privacy Policy, from time to time (including, without limitation, to reflect company and customer feedback).
